Ashley St. Clair, the author who recently revealed having a child with the mogul Elon Musk, is now allegedly suing him for full custody of her supposed child.
On February 14th, St. Claire had claimed via X that she had welcomed what would be Musk’s thirteenth child five months earlier. “Five months ago, I welcomed a new baby into the world. Elon Musk is the father,” she wrote at the time. “I have not disclosed this previously to protect our child’s privacy and safety, but in recent days it has become clear that the tabloids intend to do so, regardless of the harm it will cause.”
The author added, “I intend to allow our son to grow up in a normal and safe environment. For that reason, I ask that the media respect our son’s privacy and refrain from invasive reporting.” Alongside the publication, St. Clair wrote “Alea Iacta Est”, which translates to “The die is cast.”

St. Claire, known for her children’s book “Elephants Are Not Birds”, filed a petition with the New York Supreme Court for child custody last Friday, February 21, according to SCOOP, who was the first to report on the filing.
In the court documents, the claimant alleges that Elon Musk is the father of her child, even though “he has only seen him three times”: “(Musk) has only seen him three (3) times and has no involvement in his care and upbringing”, the petition allegedly states. The petition also claims that the child, known as R.S.C., was born in September 2024.
In addition to requesting sole custody, St. Claire also allegedly filed a paternity petition.
According to the document, St. Claire allegedly claims that she and Musk had a “romantic relationship around May 2023”. Additionally, she claims that they had sexual relations and that her alleged child was conceived in January 2024.
Musk reportedly “acknowledged paternity of the child in various written correspondences”, claims St. Clair, who also alleged to have exchanged text messages with Musk about his son after his birth and sent a photograph of the child to Musk. “I look forward to seeing you and him this weekend,” Musk allegedly replied, according to the reported documents.
