The New York Prosecutor’s Office recommended Judge Juan Merchán to postpone the sentence of newly elected president Donald Trump. Merchán found Donald Trump guilty of 34 charges related to hush money payments to porn actress Stormy Daniels.
For now, Trump's lawyers plan to present new legal arguments in favor of dismissing the case.
Judge Merchán has not yet made the final decision.
The Manhattan District Attorney, Alvin Bragg, stated that the proposal needs the approval of Judge Merchán to become official. Previously, in other cases, Juan Merchán has received requests for postponements and has granted them.
"The prosecutors said they would challenge Trump's efforts to dismiss the case, but agreed that they are in uncharted territory when it comes to sentencing a president, and acknowledged that his sentence may have to wait until the end of the Republican's term," explains Telemundo on its website."
Sentence for Donald Trump
The judge had set November 26 as the date to sentence Donald Trump for the 34 serious crimes of falsification of commercial records.
"The people deeply respect the Office of the President, are aware of the demands and obligations of the presidency, and recognize that the accused's inauguration will raise unprecedented legal issues. We also deeply respect the fundamental role of the jury in our constitutional system," the prosecutors said in their recommendation to the judge.
The prosecutors said they would agree to postpone the sentencing for "two reasons": one related to Trump's lawyers' requests to dismiss the case, and the other regarding the issue of presidential immunity.
Trump was accused last year of falsifying business records to cover up the reimbursement of a payment in exchange for silence that his then-lawyer Michael Cohen made to the porn star Stormy Daniels in the final days of the 2016 election.
